"This lawsuit is without merit," Sills Cummis General Counsel Richard Epstein said in a statement about the suit. "Mr. Hekemian owes the firm a significant amount for the legal services that he requested, and we will be filing a counterclaim to collect all sums due."

The suits cite the holding from Jarkesy that the Seventh Amendment requires the SEC to bring civil penalty proceedings for security fraud in federal court, where the defendant is entitled to a jury, rather than do so in an in-house administrative proceeding.

"As the largest employer in the world, Amazon makes clear that it does not believe the law applies to it and that they are free to treat their employees how they see fit. The law does not support this belief," the plaintiff said in a court filing.

"For all of the pomp and circumstance surrounding the premium brands and high-end fashion on its racks and shelves, luxury retailer Neiman Marcus takes a comparatively cut-rate approach to the data security protocols for its customers' data," the Delaware suit states.

The defendants also claimed the plaintiff was partly to blame for waiting five days after the device was implanted.

"[T]here is a difference between an individual having the freedom to pursue and obtain safety and happiness and the state having an obligation to guarantee the safety and happiness of its citizens," Christopher Porrino, an attorney for the Casino Association of New Jersey, said at a hearing in the case.

“An engaged and informed citizenry improves public trust in the courts and strengthens our justice system as a whole. And as technology evolves, it affords greater opportunities to expand public access to the courts,” Chief Justice Stuart Rabner said in a statement.

Michael Hanus used the Audi to travel to and from his law office, to the courthouse and to visit clients, but he used a different vehicle on the weekends or when transporting his children because of the Audi's mechanical problems, according to court documents.

The accusations in the suit by Carl Dranoff and two of his companies in Camden County Superior Court mirror the charges in a racketeering indictment brought by the state against the Norcross brothers and four others in June.
