Advertisement 2 Article content Repeat offender sentenced for fall break-in Back to video And while he has a lengthy criminal record, Henry vows the courts have seen the last of him. “I'm not going to be a problem anymore in society,” the 34-year-old told Ontario Court Justice Julie Lefebvre. “I grew up a little bit (in custody). I apologize.” “Looking at your record, (the four new convictions) is all property-related,” Lefebvre told Henry. “You broke into someone's home. You were in possession of a stolen vehicle. (Change) up to you.” “I know exactly what I have to do,” replied Henry. Lefebvre, accepting a joint sentencing submission by the Crown and defence lawyer John Raferty, issued a suspended sentence. The sentence recognized the 224 days (336 days of pre-trial custody credit) Henry had been in jail. Nine months of that time was credited to the four offences Henry had pleaded guilty to. Advertisement 3 Article content A one-year probation order was also issued, with conditions that Henry take treatment as directed and provide a DNA order. As a result of the pleas and suspended sentence, the offender was released from custody. Henry had pleaded guilty to break, enter and theft, two counts of breach of probation, and possession of stolen property over $5,000. The court heard that about 11 a.m. Oct. 18 last fall, Henry broke into an Albinson Street apartment and stole electronic items, including a laptop computer and power bank. He put the items in a garbage bag when he left. The female tenant had been away for only 20-30 minutes and returned to find her television on the floor, the cupboards open and electronic items missing. A surveillance video captured the theft and Greater Sudbury Police officers who viewed it recognized Henry. Advertisement 4 Article content At the time, Henry was on a probation order issued in July 2023. Then about 10:35 p.m. Dec. 5, Greater Sudbury Police dealt with a 911 hang-up call involving a Willow Street residence that Henry was not to be at as a condition of a court order. Officers found him in the living room and arrested him. About 1:45 p.m. on Dec. 19, police officers spotted Henry in a stolen Honda Civic idling on Willow Street. At one point, Henry got out of the vehicle and left but returned later and police arrested him. Henry, who was still on a probation order, had remained in custody since the incident. Henry's criminal record includes a six-month jail sentence in March 2015 for purchasing cellphones with stolen identification. He also received a nine-month sentence, along with 100 hours of community service, in January 2018 for seven offences, including the theft of two Royal Canadian Legion poppy boxes at the same Tim Hortons restaurant in the city.
