On December 3, 2024, the U.S. District Court for the Eastern District of Texas issued a nationwide preliminary injunction blocking enforcement of the Corporate Transparency Act (CTA) and its Beneficial Ownership Information (BOI) reporting requirements. This ruling prevents the U.S. Department of the Treasury and the Financial Crimes Enforcement Network (FinCEN) from enforcing these provisions until further notice.

In our last client alert on the CTA, we informed you that on December 3, 2024, the U.S. District Court for the Eastern District of Texas issued a nationwide preliminary injunction blocking enforcement of the CTA and its Beneficial Ownership Information (“BOI”) reporting requirements and that, as a result, the CTA’s reporting requirements were temporarily suspended. However, on December 23, 2024, the US Court of Appeals for the Fifth Circuit lifted the injunction. As a result, covered entities are again required to file their BOI reports.
